Terms for Wedding Cakes

2011 Terms and Conditions for Commissions of Wedding Cake by Zillycakes, LLC

1.      All deposits are non-refundable.

2.      $75.00 deposit holds your wedding date.  If you request Photoshop sketches, a set is $60, and includes one revision.  Once you have received a contract by email, 50% of your balance is due.

3.       Once you have made the 50% deposit, your date and time cannot be changed.

4.      Changes can be made on the design of the cake up to 1 month prior to the event.  We encourage you to touch base with us 2 to 4 weeks before your wedding to make sure we are all on the same page!

5.      Changes in the number of servings or the flavor of the cake can be made up to 2 weeks prior to the event.  Due to the way we organize our food purchasing, we insist that no changes be made on your cake within one week of your event.

6.      Final cake payments are due 2 weeks prior to the event, as shown on your contract.  If payment is not received within 3 days of that date, a 10% penalty will be added.  You will not receive a phone call or email reminding you that payment is due, however, we will respond to your email inquiries about the date & final amount due.

7.   If your cake has not been paid for in full 1 week before your event, we will not make your cake.  You forfeit all previous payments.

8.   For orders to be picked up, payment of your balance is due in full at time of pick up. 

9.   Zillycakes does not give whole or partial refunds on custom cakes for any reason.

10.  You are purchasing the physical cake.  Zillycakes LLC retains the right to the cake design and any photographs taken of the cake by Zillycakes LLC’s staff members.  You retain the rights to any images taken of the cake at your event.  We love it when you send us pictures of you with your cake!

11.  Zillycakes strives to be true to all plans and details as discussed in conversations and as shown in sketches.  However, since cake is a tricky medium affected by extreme temperatures and subject to structural issues, we retain the right to alter any design as needed to avoid disaster.  Trust us; you really want us to use our best judgment in the moment!  If we must alter your design or plans in any way, we will do our best to communicate this with you ahead of time if possible.

12.  Zillycakes is not responsible for the cake after the cake is set up at the reception. We photograph the finished cake, give the staff serving instructions, and do our best to set you up for success, but we have seen photographers and caterers move fully stacked cakes, and we cannot be responsible for actions beyond our control.  We do not recommend setting cakes up on cake stands or pedestals. 

13.  Social media promotions (Groupon, Living Social, Deal of the Day, etc.) are not applicable to custom products at Zillycakes.  They are solely for use at the walk-in cupcake bar.
